Terms & Conditions

These Terms & Conditions (“Terms”) govern all transactions, services, and interactions with Eli Adams Jewelers, Inc. (“Company,” “we,” “our,” or “us”). By purchasing merchandise, leaving items for repair or layaway, or signing up for communications, you agree to these Terms.

1. Layaway Policy

  • Minimum 10% initial deposit required. If less than 10% is placed at initiation, the customer must return within 7 days to complete the deposit.
  • Layaway period is 2 months (60 days). Payments are due every 30 days.
  • Deposits are non-refundable.
  • Deposits may be applied only toward merchandise from the issuing vendor or store credit.
  • If merchandise on layaway has been sized, altered, or engraved and the layaway is canceled, we reserve the right to charge a restocking fee up to 90% of the item’s value.
  • Layaway accounts not paid in full by the due date may be canceled; all deposits and payments may be forfeited.

2. Repairs & Storage

  • We will exercise reasonable care in handling items left for repair or service. Customers are encouraged to maintain their own insurance coverage; we do not insure items left in our possession.
  • Items not claimed within 60 days of notification that the item is ready for pickup are deemed abandoned. Upon abandonment, all rights, title, and interest in the property automatically transfer to Eli Adams Jewelers. We may retain, resell, or dispose of the property without further notice or liability.
  • We are not liable for loss, theft, or damage to any item left beyond the 60-day period.

3. Warranty

  • Manufacturer warranties are valid only with the original sales receipt and the manufacturer’s warranty card. If either is missing, the warranty is void.
  • Only side diamonds up to 0.10ct are warrantied for 1 year against manufacturing defects.
  • Center stones are not covered under any condition.
  • Warranty excludes normal wear, misuse, negligence, accidents, and unauthorized repairs.

4. Custom Orders

  • Custom orders require approval of design specifications by the customer.
  • If a customer declines a custom piece due to workmanship concerns, a fee of $250 or 10% of the item value (whichever is higher) applies.
  • Custom, engraved, altered, or personalized items are non-refundable and non-exchangeable.

5. Exchanges & Returns

  • All returns and exchanges require the original sales receipt.
  • Returns are accepted within 30 days of purchase.
  • Items must be returned in original condition, including the original box, packaging, papers, certificates, and tags. Tags must not be removed; items with missing/removed tags or documentation are ineligible.
  • Not eligible for return/exchange: special orders; custom-made or altered jewelry (including sizing or engraving); layaway purchases; watches with links added or removed; items showing wear, damage, or tampering; and Final Sale/clearance/promotional/discounted items.
  • Returned checks are subject to a $75 service fee.

6. Inspection & Acceptance at Pickup

Customers are requested to inspect merchandise and repaired items at the time of pickup. Upon acceptance and pickup, items are considered to be in satisfactory condition and are fully in the customer’s care.

7. Payment & Financing

  • Payments for layaway, repairs, and purchases must be made as scheduled.
  • Late or failed payments may result in cancellation of the layaway, forfeiture of deposits, and/or additional fees.

8. SMS & Email Communications

  • By signing or providing contact details, you consent to receive recurring automated SMS and email communications (including promotions, product updates, reminders, and event invitations). Consent is not a condition of purchase.
  • Opt-Out: SMS—reply STOP (a confirmation message may follow). Email—use the unsubscribe link in any email (processing may take up to 10 business days).
  • Standard message/data rates may apply. Carriers are not liable for delayed or undelivered messages.

9. Privacy & Data Use

We collect and process customer information to fulfill purchases, manage layaway/repairs, and send communications. We may share data with payment processors, shipping providers, marketing & advertising partners (including Google, Facebook, and Instagram), SMS/email platforms, and analytics providers. 10. Limitation of Liability

To the fullest extent permitted by law, Eli Adams Jewelers is not liable for indirect, incidental, punitive, special, or consequential damages, including loss of value, sentimental loss, or emotional distress. Our total liability for any claim shall not exceed the amount paid by the customer for the related transaction.

11. Dispute Resolution

  • Disputes must first be brought to management for good-faith resolution.
  • If unresolved, disputes proceed to mediation in Bergen County, NJ; mediator costs are shared equally.
  • If mediation fails, disputes shall be resolved exclusively in the state or federal courts of Bergen County, New Jersey.
  • By doing business with us, you waive the right to participate in class or representative actions to the maximum extent permitted by law.

12. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, acts of war or terrorism, labor disputes, governmental actions, and power or internet outages.

13. Changes to Terms

We may update these Terms at any time. Changes will be posted on our website with the revised effective date. Continued use of our Services constitutes acceptance of the updated Terms.
